Privacy Matters. Yours is Protected with Healthix.

Healthix and our Participants comply with New York State and Federal privacy and confidentiality laws, such as HIPAA, to protect the privacy and security of your information. Access to your clinical data through Healthix is limited to the healthcare providers who are involved in your care and the organizations that you grant consent to. Healthix tracks and audits all access to health information in our system. Mandatory audits are conducted to ensure proper use and compliance with patient consent policies.

 

Who can see my health information?

Only doctors and other staff members of the Organization(s) you have given consent to access who carry out activities permitted by the consent form.

Your electronic health information will be used only for the following healthcare services:

Public Health and Organ Procurement Organization Access

Federal, state or local public health agencies and certain organ procurement organizations are authorized by law to access health information without a patient’s consent for certain public health and organ transplant purposes. These entities may access your information through any New York State Qualified Entity for these purposes without regard to whether you give consent, deny consent or do not fill out a consent form.

What type of information will be shared?

If you give consent, the Provider Organization(s) and/or Health Plan(s) listed may access ALL of your electronic health information available through Qualified Entity. This includes information created before and after the date this form is signed. Your health records may include a history of illnesses or injuries you have had (like
diabetes or a broken bone), test results (like X-rays or blood tests), and lists of medicines you have taken. This information may include sensitive health conditions, including but not limited to:

If you have received alcohol or drug abuse care, your record may include information related to your alcohol or drug abuse diagnoses, medications and dosages, lab tests, allergies, substance use history, trauma history, hospital discharges, employment, living situation and social supports, and health insurance claims history.

How long will my consent be valid ?

The NYS HIE Consent Form will remain in effect until the day you change your consent choice or until such time as Qualified Entity ceases operation (or until 50 years after your death whichever occurs first). If Qualified Entity merges with another Qualified Entity your consent choices will remain effective with the newly merged entity.

If you are a minor , your parent or legal guardian may file a consent on your behalf until you turn 18. On or after your 18th birthday you can file the consent yourself. There are specific circumstance where a minor patients who receive minor consented services can provide a consent to the provider of these type of services (HIV/AIDS and STD services, reproductive care, some mental health or substance use/prevention services) directly without a parent or legal guardian.

Changing Your Consent Choice

You can change your consent choice at any time and for any Provider Organization or Health Plan by submitting a new Consent Form with your new choice(s). Please note that if you granted a consent in the past for particular providers, those providers may copy or include your information in their own medical records until you file a Deny consent. When you decide to change your “Grant” consent decision to “deny”, providers are not required to return your information obtained previously or remove it from their records.
